Abstract
Staatskirchenverträge mit den großen christlichen Kirchen sind ein altes und vielerprobtes Instrument zur Koordination ihrer jeweiligen Rechte und Interessen, waren aber immer auch Gegenstand des Streits: »Concordatum – mater rixarum ». Julia Lutz-Bachmann widmet sich der verfassungsrechtlichen Untersuchung der Fortentwicklung des Staatskirchenvertragsrechts hin zu einem paritätischen Religionsverfassungsvertragsrecht insbesondere in der zweiten Hälfte des 20. Jahrhunderts. Aufbauend auf einer historischen Herleitung und einer Beleuchtung der grundsätzlichen verfassungsrechtlichen Probleme dieses Rechtsgebiets analysiert sie Inhalte und verfassungsrechtliche Implikationen von Verträgen des Staates mit jüdischen und muslimischen Gemeinschaften. Im Ergebnis zeigt sich, dass der religionsverfassungsrechtliche Vertrag zwar »mater rixarum » bleibt, er sich aber auch unter den Bedingungen einer pluralen religiösen Landschaft neu bewährt und durch die Herstellung von Einzelfallgerechtigkeit vielfältige Chancen zu Ausgleich und Befriedung im freundlich-fördernden neutralen Staat birgt.

State church treaties with the major Christian churches are an old and well-tried instrument for coordinating their respective rights and interests, but they have always been the subject of controversy: » Concordatum - mater rixarum». Julia Lutz-Bachmann devotes herself to the constitutional investigation of the further development of the state church treaty law towards an equal religious constitutional treaty law, especially in the second half of the 20th century. Based on a historical derivation and an illumination of the fundamental constitutional problems in this area of law, she analyzes the content and constitutional implications of state treaties with Jewish and Muslim communities. The result shows that the religious constitutional treaty is » mater rixarum »Remains, but it also proves itself anew under the conditions of a plural religious landscape and, through the creation of case-by-case justice, harbors various opportunities for balance and pacification in the friendly, supportive, neutral state.
