Abstract: Cet article porte sur la manière dont la Mission d’étude sur la spoliation des Juifs de France ‑ en la personne de son groupe « œuvres et objets d’art » ‑ a traité le cas des spoliations d’œuvres d’art. Il s’est agi notamment du cas des œuvres communément appelé « les MNR », à savoir quelque 2 000 œuvres d’art rapatriées d’Allemagne ‑ et donc potentiellement spoliées ‑ qui au début des années 1950 ont été confiées aux musées nationaux. Ce travail publié sous l’égide de la Mission Mattéoli suscite aujourd’hui plusieurs interrogations : celle‑ci ont trait à la mise en œuvre de la recherche menée, à son fondement en ce qui concerne certains des chiffres avancés, puis aux personnes ou institutions qui en portent la responsabilité. En cela, cet article, fondé essentiellement sur les différents rapports publiés, porte sur ce qui différencie le rapport portant sur les œuvres d’art des autres travaux de la Mission Mattéoli ainsi que sur la nature des décalages constatés, qui mériteraient une étude plus approfondie.

Abstract: Il y a dix‑huit ans, par le décret du 10 septembre 1999, les autorités françaises instituaient auprès du Premier ministre la Commission pour l’indemnisation des victimes de spoliations intervenues du fait des législations antisémites (CIVS), « chargée d’examiner les demandes individuelles présentées par les victimes ou par leurs ayants droit pour la réparation des préjudices consécutifs aux spoliations de biens intervenues du fait des législations antisémites prises, pendant l’Occupation, tant par l’occupant que par les autorités de Vichy ». La CIVS devra « rechercher et proposer les mesures de réparation, de restitution ou d’indemnisation appropriées ».

Not Facing the Past: Restitutions and Reparations in Italy (1944‑2017)

Abstract: This essay provides a partial reconstruction of some measures of restitution and reparation adopted by the first post‑Fascist Italian administrations on behalf of Jews. These measures reached their peak in 1945‑1947 and had a final addendum in 1955, with the passage of a law, still in force, that awarded former victims of persecution some compensation for their suffering but, overall, the reparation measures were vastly insufficient. In the Nineties, the period of antisemitic persecution came back into the Italian political spotlight, as part of a new wave of international attention focused on the consequences of the Shoah from a financial standpoint as well, due to the phenomenon of the Holocaust litigations. Nevertheless the Italian response was once again characterized by resistance, reticence and silence.

Abstract: Cet article analyse la politique de « réparation » allemande au début du xxie siècle à travers l’exemple de ce qu’on désigne sous l’expression « pensions de ghetto ». Il se fonde sur des documents rendus accessibles par la Loi sur la liberté de l’information. À partir de 2002, d’anciens internés des ghettos ont pu bénéficier du système de sécurité sociale allemand s’ils étaient à même de prouver qu’ils avaient travaillé dans des conditions bien spécifiques. Jusqu’en 2009 cependant, plus de 90 % des requêtes ont été rejetées parce que les fonds de pension et le gouvernement souhaitaient avant tout faire des économies, sans que les juges aient marqué leur volonté de mettre fin à ce scandale. Ce n’est qu’en 2009 qu’une décision historique a modifié ce comportement mais même depuis lors il apparaît clairement qu’aujourd’hui comme dans la seconde moitié du xxe siècle, de telles indemnisations sont perçues en Allemagne comme un fardeau indésirable.
Second‑Wave Holocaust Restitution, Post‑Communist Privatization, and the Global Triumph of Neoliberalism in the 1990s

Abstract: This article argues show that the emergence in the 1990s of a second wave of Holocaust‑era restitution claims was not the result of a shift in mentalities leading to the sudden recognition of past wrongs or the surge of repressed memories but rather part of a larger process involving major transformations in global capitalism and property regimes. Restitution, fashioned as re‑privatization, surfaced in the early 1990s in connection with post‑Communist de‑collectivization and was included in neoliberal reform packages adopted by transitional societies in Central and Eastern Europe. By the end of that decade, restitution attained a much wider significance as a token of justice, memory, and identity. International scrutiny of restitution mechanisms implemented by post‑Communist states turned the restoration of property rights into an indicator of these societies’ commitment to human rights and their willingness to address the legacies of their totalitarian past. As a “travelling concept” linking private property with novel ideas of historical justice on its road from east to west and west to east, restitution gradually changed from a method of advancing privatization and creating new polities to a carrier of the memory of past wrongs. In this entirely new meaning, restitution became the heart of Holocaust survivors’ fin‑de‑siècle call for justice and recognition.
Impossible History? Holocaust Commissions as Narrators of Trauma

Abstract: Historical commissions have played an important role in the most recent efforts to garner restitution and reparations for Holocaust victims and their families. Several dozen Holocaust commissions were convened in the late‑1990s and early‑2000s in European countries where histories of collaboration and complicity with the Nazi regime were either under‑documented or suppressed in the official discourse. This essay examines the Holocaust commissions from a historiographical perspective with special attention given to the methodological and rhetorical strategies they employed when confronted by the traumatic experiences and memories of victims and survivors. While the work of these commissions was shaped and influenced, to varying degrees, by external political forces and interest groups, this essay explores the ways in which “the politics of history” entered into their written reports and, consequently, obscured and silenced fundamental aspects of Holocaust history. Three commissions, in particular, are held up for scrutiny (i.e., Austria’s Jabloner Commission, the International Commission for Holocaust‑Era Insurance Claims, and France’s Mattéoli Commission), and an assessment of their work is given against the backdrop of ongoing debates within the field of trauma studies and in response to questions concerning the Holocaust and the “limits of representation.”
