Abstract: Staatskirchenverträge mit den großen christlichen Kirchen sind ein altes und vielerprobtes Instrument zur Koordination ihrer jeweiligen Rechte und Interessen, waren aber immer auch Gegenstand des Streits: »Concordatum – mater rixarum ». Julia Lutz-Bachmann widmet sich der verfassungsrechtlichen Untersuchung der Fortentwicklung des Staatskirchenvertragsrechts hin zu einem paritätischen Religionsverfassungsvertragsrecht insbesondere in der zweiten Hälfte des 20. Jahrhunderts. Aufbauend auf einer historischen Herleitung und einer Beleuchtung der grundsätzlichen verfassungsrechtlichen Probleme dieses Rechtsgebiets analysiert sie Inhalte und verfassungsrechtliche Implikationen von Verträgen des Staates mit jüdischen und muslimischen Gemeinschaften. Im Ergebnis zeigt sich, dass der religionsverfassungsrechtliche Vertrag zwar »mater rixarum » bleibt, er sich aber auch unter den Bedingungen einer pluralen religiösen Landschaft neu bewährt und durch die Herstellung von Einzelfallgerechtigkeit vielfältige Chancen zu Ausgleich und Befriedung im freundlich-fördernden neutralen Staat birgt.

Abstract: While there is an abundance of literature on ethnicity and ethnic group formation, the relationship of ethnicity to the state is rarely addressed. This paper discusses some classical and contemporary approaches to this question and proposes the concept of "ideological labor": ethnic groups performing a specific ideological function within society. The case discussed here is that of postwar German Jewry. The presence of Jews in postwar West Germany, it is argued, was vital for domestic and foreign policy reasons and Jews performed the role that was expected of them.

Abstract: This response puts Tzuberi's analysis into a broader comparative context. First, the post-1990 attempt to create Jews in the image of the liberal-secular German nation-state met considerable resistance by the Central Council of Jews in Germany. In addition, the majority of post-Soviet Jews showed no interest in liberal Jewish theology or the fantasy of reviving the German-Jewish past. Second, the milieu of Judaizing Germans (core architects of German-Jewish revivalism) shows a strong resemblance to other attempts of escaping colonial whiteness, including patterns of what has been called »ethnic fraud.« Third, in comparison to other cases of minority repatriation, the German practice of expiatory demographic engineering was relatively cost-intensive, but contributed considerably to the country's »nation re-branding« after reunification. Fourth, the German politics of reforestation vis-à-vis its Jewish community points to the rise of a post-migratory »gardening state,« heavily invested in regulating its diverse population through a policy mix of migration, education and surveillance.

Abstract: This article argues that German post-unification state ideology entails a »return of Jews« and the »flourishing of Jewish life« as a means of readmission into the circle of civilized nations. Drawing on parliamentary debates about the migration of Jews from the former Soviet Union, it foregrounds the state as a central player in revival politics and demonstrates how state-administered revival politics are oriented towards the reconstruction of German Jewry in the image of a substantially German, acculturated pre-war community. It contextualizes the recent establishment of rabbinical and confessional schools in a German state university within German revival politics and argues that the successful incorporation of Jews into the new German nation-building project indicates the neutralization of the past within institutional memory and minority politics.

Abstract: Much has been written about the scarf affairs in France and the subsequent legislation banning large religious symbols from the classroom. Less has been written about the major religious leaderships' responses from 1989 when the first affair took place until the debates surrounding the Stasi Commission in 2003. This article traces the evolution of their thinking with special emphasis on the splits within the Jewish leadership within the context of a rise of anti-Semitic acts.

Abstract: This article focuses on the relationship between the two major ethnoreligious communities – the Jews and the Muslims – and the state in France, as reflected in lobbying, electoral behaviour, and public policies. It shows how the evolution of that relationship, an aspect of the politics of ethnicity, religion and multiculturalism, has been both a cause and a consequence of modifications in approaches to secularism, communitarianism and affirmative action. Finally, it deals with the question to what extent this development corresponds to a pluralist or corporatist model of politics and argues that changes in the relationship between state and society suggest an evolving accommodationist pattern increasingly similar to that of the United States.

Abstract: This book explores the emergence and expansion of global kosher and halal markets with a particular focus on the UK and Denmark. Kosher is a Hebrew term meaning 'fit' or 'proper' while halal is an Arabic word that literally means 'permissible' or 'lawful'. Abstract: Quelles sont les conditions de possibilité des affirmations identitaires juives contemporaines ?
Pourquoi celles-ci peuvent-elles déstabiliser le modèle confessionnel qui a caractérisé le mode
d'insertion des Juifs en France jusqu'aux années 1970 ? Une analyse historique comparative montre
l'importance de deux facteurs de transformations internes du judaïsme français : le facteur
démographique (fortes migrations des années d'avant guerre et celles des années 1950-1960) et le
type de judaïsme vécu, caractérisé dans les deux cas par ses traits d'évidence, d'immédiateté et par
sa dimension collective. Mais ces conditions, nécessaires, ne sont pas suffisantes. L'analyse
comparative des contextes globaux, celui de l'avant-guerre et celui des années 1970 à nos jours,
montre que les enjeux ont évolué de manière décisive : si l'émanci pation est un objectif à consolider
ou à atteindre dans la première période, c'est l'identité qui, ensuite, pose problème. Les réponses à
ces enjeux n'en sont pas moins plurielles dans chaque cas.

Abstract: En considérant les évolutions du pluralisme et les transformations de l’État-nation, je
propose de comparer l’intégration, à deux époques différentes, des juifs et des musulmans en
France. Après avoir précisé les caractéristiques du «modèle confessionnel» qui a présidé à
l’intégration des juifs en France au XIXe siècle. et montré la déstabilisation actuelle de ce modèle,
j’en viens à souligner combien c’est toute la société française qui a évolué: sécularisation interne
croissante des religions, transformations de la laïcité vers une plus grande acceptation du
pluralisme religieux et vers une «publicisation» de ce religieux. Or les populations musulmanes de
France se sentent désormais partie prenante de ces processus, en raison notamment de la place
plus importante prise par les jeunes générations dans leur leadership; elles aspirent donc à un
traitement identique à celui des autres groupes religieux. C’est pourquoi, tout en connaissant un
processus de «confessionnalisation» de leur identité traditionnelle, elles refusent de se cantonner
à une intégration suivant ce seul modèle •lequel est au coeur du «modèle républicain
d’intégration» que les musulmans seraient sommés de respecter.

Abstract: Este año se conmemora en España el Bicentenario de la Constitución de Cádiz de 19 de
marzo de 1812. Durante estos dos siglos muchas cosas han cambiado y muy
particularmente, en las relaciones entre el Estado y las confesiones
religiosas. Con la vigente Constitución de 1978 queda razonablemente resuelto
uno de los problemas permanentes en la historia del constitucionalismo español
como es la llamada “cuestión religiosa”. El reconocimiento de la libertad
religiosa ha traído consigo un pluralismo religioso que se refleja en una diversidad
de confesiones en la sociedad española que, progresivamente, van adquiriendo
una mayor presencia social. En nuestro país los judíos son una minoría
religiosa que no supera los 40.000 miembros. En Baleares, la población judía
está perfectamente integrada en la sociedad junto al resto de religiones y
comparte las mismas inquietudes que el resto de ciudadanos. Al coincidir en
este año 2012 otras conmemoraciones como la del XXV aniversario de la sinagoga
de Palma de Mallorca y el XX aniversario del Acuerdo suscrito entre el Estado
español y la Federación de Comunidades Judías de España, se presenta en este
libro un estudio del régimen jurídico y la evolución histórica de la Comunidad
judía de las Islas Baleares. El libro constituye, pues, una importante aportación científica que recoge trabajos de
representantes de la Comunidad Judía balear, de representantes de la Administración pública balear y de profesores expertos de diferentes Universidades españolas.

Abstract: El respecte a la pràctica funerària és un dels aspectes que explícitament es recullen en el
marc de reconeixement de les tradicions religioses minoritàries amb acord de cooperació
